The trial of the former Minister of Power, Olu Agunloye continued on Thursday, July 2, 2026, before Justice Jude Onwuegbuzie of the Federal Capital Territory High Court, Apo, Abuja with the conclusion of the re-examination of the Fifth Prosecution Witness, PW5, Iliya John Iyakwari, who affirmed that Exhibit EFCC 3D and Exhibit EFCC 3K, containing the extracts of the minutes of the Federal Executive Council meeting of May 21, 2003 regarding the contract for the 3960Mw Mambilla Hydro-Electric Power Project are the same and verbatim in the deliberations, resolutions, conclusions and directives.

Agunloye is facing prosecution by the Economic and Financial Crimes Commission, EFCC, on an amended seven-count charge bordering on official corruption and fraudulent award of the Mambilla Power Project contract to Sunrise Power Transmission Company Limited to the tune of $6billion (Six Billion United States Dollars).

At Thursday`s proceeding, prosecution counsel, Abba Muhammed, SAN, reminded the court that during the cross-examination of PW5 on June 18, 2026, defence counsel, Adeola Adedipe, SAN, showed the witness, a former Assistant Director, Legal,   in the Federal Ministry of Justice, now serving in the Federal Ministry of Power as an Assistant Legal Adviser, Exhibit EFCC 3D and Exhibit EFCC 3K and asked him to take a look at some portions of both exhibits and make comparisons to which the witness responded that Exhibit EFCC 3D was not known to him.

On this score, the prosecution counsel directed the witness to take yet another look at Exhibit 3D and Exhibit 3K and go through the extracts of the minutes of the Federal Executive Council, FEC meeting of May 21, 2003 regarding the contract for the 3960MW Mambilla Hydro-Electric Power Project and confirm to the court if the deliberations, resolutions, conclusions, and directives therein are the same, verbatim or not, to which the witness confirmed that they were the same.

Justice Onwuegbuzie adjourned the matter till July 6 for continuation of the trial.
