The National Drug Law Enforcement Agency (NDLEA) has clarified that its primary drug trafficking case against suspended Deputy Commissioner of Police, Abba Kyari, remains unaffected by a recent court ruling dismissing separate charges against him.
The agency’s statement comes in response to a decision by Justice James Omotosho of the Federal High Court, who discharged Kyari on a 23-count charge involving alleged non-declaration of assets and money laundering.
Despite the setback in the asset-related case, the NDLEA emphasised that the “substantive” case, which centres on allegations of drug trafficking, is still very much active. That trial is scheduled to continue before Justice Emeka Nwite on Monday, March 16, 2026.
Femi Babafemi, the NDLEA’s Director of Media and Advocacy, spoke to reporters to clear up public confusion regarding the two distinct legal proceedings.
“First, I need to clarify that the ruling by Justice Omotosho is completely different from the main and substantive drug case,” Babafemi stated. “That one is very much on course.”
When questioned on whether the NDLEA intends to appeal Justice Omotosho’s ruling, the agency remained cautious. Babafemi noted that the legal team must first dissect the court’s reasoning before committing to further litigation on the asset charges.
“The prosecution team has been directed to apply for the Certified True Copy (CTC) of the judgment,” Babafemi explained. “The details will help the management make a decision on what to do next.”
Abba Kyari, once a highly decorated “super cop” and head of the Intelligence Response Team (IRT), has been embroiled in multiple legal battles since 2022.
The NDLEA’s primary suit alleges that Kyari and several subordinates were involved in a conspiracy to deal in 17.55 kilograms of cocaine. While the asset declaration case handled by Justice Omotosho focused on the financial trails and disclosure of properties, the upcoming March 16 proceedings will return the focus to the alleged narcotics violations that originally led to his suspension. #Securitynewsalert.com
